Waiver and Release of Liability

FOR EXERCISE PROGRAMS INCLUDING BUT NOT LIMITED TO 1:1 PERSONAL TRAINING, SEMI-PRIVATE TRAINING, AND GROUP TRAINING SESSIONS

This WAIVER AND RELEASE OF LIABILITY “Waiver and Release” is hereby executed by Client (“Client”) in favor of By Syd LLC. By signing below, Client, the undersigned, hereby acknowledges that Client is participating in a training session or program with By Syd LLC at Client’s sole discretion, assumes all risk relating to the program or session, and waives and releases By Syd LLC from and against any and all liability relating to the program or session.

While participating in the training program or session, Client will engage in certain athletic activities (“Activities”). Client’s choice to engage in these Activities is entirely voluntary and Client is solely responsible for any injuries or health related issues that may occur in undertaking those Activities. Client hereby further agrees as follows:

Activities Waiver. Client understands that participation in any Activities while participating in a training session or program may lead to or result in injury, incur or exacerbate a health-related condition, or result in death. Client should not participate in any Activities unless Client is medically able to do so. Participation in any Activity is done knowingly and voluntarily, and Client assumes all risks associated with Client’s participation in the Activities. Client understands that partaking in any Activities could carry inherent risks and could result in serious injury or even death. Client and Client’s heirs, estate, successors or assigns waive all liability and release By Syd LLC and Sydney Sherman individually, any related business entities, or any of their business partners, family or friends (“Released Parties”) for any damage, injury, death, costs, expenses, claims or liability arising from your participation in any Activities.

Hold Harmless. Client agrees to hold By Syd LLC and Sydney Sherman individually, harmless for any omissions, errors, acts, whether known or unknown to Client, and from any damage, injury, death, costs, expenses, claims or liability arising from your participation in any Activities.

Release of Liability. Client and Client’s heirs, estate, successors or assigns hereby release By Syd LLC and Sydney Sherman individually, and any related business entities, or any of their business partners, family or friends (“Released Parties”) for any damage, injury, death, costs, expenses, claims or liability arising from your participation in any Activities.

I, the undersigned, as Client, have read and understand all the terms and conditions and agree with them. By signing below, I acknowledge this Waiver and Release and agree to voluntarily sign this Waiver and Release to release By Syd LLC and Sydney Sherman individually, from any liability related to the training program or session.
